‘CONTEST PERIOD’ DATES:
The Sweepstakes begins on Monday, September, 12th, 2022 at 2:00PM Pacific Time (“PT”) and ends at 5:00PM Pacific Time ("PT") on October 10th, 2022. The Sweepstakes repeats on a weekly basis on September 19th, 2022, September 26th 2022, October 3rd, 2022, and October 10th, 2022, respectively (the “Sweepstakes Period”). The Sponsor’s computer, or that of its designee, runs the official clock for the ‘Sweepstakes Period’ and will solely determine the time by which an entry is received.
ELIGIBILITY:
The ‘Contest Period’ is open to legal residents of the fifty (50) United States and the District of Columbia, who are eighteen (18) years of age or older at the time of entry and have an Instagram, Twitter, TikTok, or Facebook account (“you” or Entrant”) prior to the beginning of the Contest Period. Employees of babyganics (“Sponsor”) and its parent company, related subsidiaries and affiliated companies, prize suppliers, and advertising and promotion agencies and each of their respective agents, representatives, officers, directors, shareholders, and employees, and the immediate families (spouse, and parents, children and siblings, and their respective spouses regardless of where they live) (collectively “Releasees”), and individuals living in the same households, whether related or not, of the above, are not eligible to enter or win a prize. Each Entrant by participating during the ‘Contest Period’ agrees to be bound by the Official Rules and that of the Sponsor’s decisions. Void outside of the United States, in Puerto Rico and where prohibited or restricted by law. The ‘Contest Period’ is subject to all applicable federal, state, and local laws and regulations.
HOW TO ENTER:
To enter during the ‘Contest Period’, log into your Instagram, Twitter, TikTok or Facebook account. By submitting your information and using your preferred account, you agree to the preferred account’s terms of use and privacy notice. If you do not agree to such terms of use and privacy notice, please do not participate in this Contest.

[1] A Pootrait is a photo of yourself (and only yourself) in response to a baby’s diaper. Content direction is available on babyganics.com/pootraits
[2] At any point during the ‘Contest Period’, log into your preferred social account.
[3] To enter, upload your Pootrait diaper reaction content on your preferred social account with the hashtag #Pootraits
[4] Babyganics will reach out to all eligible content creators within 24 hours (Mon – Fri) to obtain approval to migrate the content onto the Pootraits gallery, found on babyganics.com/pootraits gallery
[5] Babyganics will reach out via comment or direct message for approval. Following your approval, Babyganics will post your content on the Pootraits gallery. This can take up to 48 hours.
[6] Once on the gallery, people will have the chance to vote on the content they like the best. The content with the most votes, will win the Prize.
[7] It is up to the sole discretion of Babyganics which photos appear on the gallery and are in the running to win a Prize
ENTRY REQUIREMENTS:
Your privacy options on your preferred social account must be set to “PUBLIC” to be vetted by the team to migrate content to the Pootraits Gallery on babyganics.com/Pootraits. Only one entry per account during the ‘Contest Period’ via the #Pootraits campaign. Users may upload content to more than one social platform. Multiple accounts per single platform may not be used, and anyone found to use multiple accounts to enter will be ineligible.
Entry Limit:
Ten (10) entries per person across all of their social media accounts. The maximum entries per person across all social media channels during the ‘Contest Period’ is ten (10). Entries received in excess of the entry limit stated herein will be disqualified. If the Sponsor determines that the content of the entry is obscene, offensive, or inappropriate, the entry will not be eligible for any prize consideration and may be withdrawn from the Contest at any time at the sole discretion of the Sponsor. Each entry submission must be manually key stroked and manually entered by the individual Entrant; automated and/or repetitive electronic submission of entries (including, but not limited to, entries made using any script, macro, bot or Contest service) will be disqualified and transmissions from these accounts or related e-mail or IP addresses may be blocked. By submitting an entry, Entrant agrees to comply with the Contest Rules. Entries may only be submitted by a single Entrant. Entries that do not comply with these Contest Rules, as determined in Sponsor’s sole discretion, will be disqualified from the Contest. Decisions of the Sponsor is final and binding.
VOTING MECHANIC:
The #Pootrait with the most community upvotes in the babyganics Pootrait Gallery will be selected within seven (7) days after the end of each ‘Contest Period’ (the “Drawing Date”) from among all eligible entries received during the Contest Period each week. Voting consensus will be conducted by the Sponsor. Decisions of the Sponsor will be final and binding on all matters relating to this Contest.
PRIZE:
There will be a total of four (4) prize winners during the ‘Contest Period’. Total ARV of each prize: $1,200 , equivalent to a year’s supply of diapers and one (1) kit of Babyganics product.
The odds of winning a prize depends upon the total number of eligible entries received during the prize period. In no event will more prizes be awarded than those listed in these Contest Rules. Winners are responsible for the payment of all taxes on the prizes. All details of the prize not specified herein shall be determined solely by Sponsor and prize provider. Except as provided herein, no cash or prize substitution is allowed except at the discretion of Sponsor, who reserves the right to substitute a prize (or prize component) with one of comparable or greater value. If prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value will be awarded; provided, however, that if prize is awarded but unclaimed or forfeited by recipient, an alternate winner will be chosen at random from the remaining eligible entries, in Sponsor’s sole discretion. By accepting prize, Prize Winner acknowledges compliance with these Rules.
WINNER NOTIFICATION AND VERIFICATION:
The Sponsor will contact potential Winners through the entry platform used to submit their entry. Notification will occur by direct message to the potential Winner's preferred social platform Account. Winners will be notified on or about the Drawing Date. The potential Winners will be required to respond to the direction in the message within 48 hours with full contact information. Potential Winners may be required to complete, sign, and return an Affidavit of Eligibility and Liability Release and; where legal, a Publicity Release (collectively the “Affidavit”). Complete document must be returned within five (5) days from prize notification date or the prize will be forfeited and awarded to an alternate potential winner. If a potential Winner (i) cannot be contacted after a reasonable attempt has been made by Sponsor; (ii) fails to timely return the required paperwork without alteration and in the form presented by Sponsor; (iii) refuses the prize; and/or (iv) the prize or prize notification is rejected or returned as undeliverable, such potential Winners forfeit all rights to be deemed a winner in the ‘Contest Period’ and receive the Prize, and that potential prize winner will be disqualified and an alternate winner will be selected through a random drawing by the Sponsor from the remaining entries. Prizes must be accepted as awarded. Except where prohibited by law, the winner’s entry and acceptance of the prize constitutes permission for the Sponsor to use said winner’s name, photograph, likeness, statements, and biographical information without further compensation.
CONDITIONS OF ENTRY:
By submitting an entry, participants are granting Sponsor and its affiliates an unlimited irrevocable, worldwide license to display, share and otherwise use the submitted content however and wherever Sponsor chooses. Participant agrees that the chance to win under this contest is the only compensation that they will receive for submitting the content.
Use of any automated entry software is prohibited. Electronically reproduced, mechanically reproduced, illegible, incomplete or inaccurate entries are void. By participating, Entrants agree to comply with these Contest Rules including all eligibility requirements. In case of a dispute as to the owner of an online entry, online entry will be deemed to have been submitted by the authorized account holder from which the entry is made. Caution: Any attempt by an Entrant or any other individual to deliberately damage any online service or web site or undermine the legitimate operation of this Contest may be a violation of criminal and civil laws and should such an attempt be made; the Sponsor reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Contest Rules shall not constitute a waiver of that or any other provision.
LIMITATION OF LIABILITY:
By participating during the ‘Contest Period’ each week, Entrants agree to release, indemnify and hold harmless Releasees and each of their respective agents, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising from participation in the Contest or acceptance, possession, use, misuse or nonuse a prize (including any travel or travel-related activity thereto) that may be awarded. These Contest prizes and these Contest Rules shall be interpreted in accordance with the laws of the State of California without regard to its principles of conflicts of law. Jurisdiction and venue shall be solely within the State of California. Releasees are not responsible for technical, computer, mechanical, printing, typographical, human or other errors relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prizes or in any Contest related materials; or for stolen, lost, late, misdirected, damaged, incomplete, inaccurate, undelivered, delayed or illegible entries or; for electronic, computer, or telephonic malfunction or error, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, or process any transaction thereon. If in the Sponsors’ opinion, for any reason this Contest is not capable of running as planned, or there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if computer viruses, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Contest, the Sponsors reserve the right at their sole discretion to disqualify any individual (and void his/her entry and/or prevent him/her from future participation) who tampers with the entry process and/or who is acting in violation of these Contest Rules, to modify or suspend the Contest, or to terminate the Contest and at Sponsor’s discretion conduct awarding of the prize using all eligible non suspect transactions and entries received as of the termination date. As a condition of entering the Contest, Entrants agree that: a.) under no circumstances will Entrants be permitted to obtain awards for, and Entrants hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; b.) all causes of action arising out of or connected with this Contest, or the prizes awarded, shall be resolved individually, without resort to any form of class action; and c.) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, and in no event shall Entrant be entitled to receive attorneys’ fees or other legal costs. Sponsor reserves the right to modify prize award procedures at their discretion.
PRIVACY:
Information collected from Entrants is used only for the purpose of awarding prizes, operating the Contest consistent with the Contest Rules and to notify Winners, and will not be re-used, sold or shared in any manner by Sponsor or any third parties unless Entrant has opted-in to receive additional information and promotional material from Sponsor or a third party. Once the Contest, including any known or unknown extensions of the Contest, has ended, all information supplied by Entrants will be removed from the database.
